The Western Sichuan Small-Group Tour Didn't Go Ahead—How Can I Get a Refund for the Tour Fee I've Paid?

Your small-group tour in western Sichuan has yet to be confirmed, even though you have already paid the tour fee and arranged your flights and time off. The biggest concern is being told at the last minute that there are not enough people to run the tour.If the travel agency cancels the contract because the agreed minimum group size has not been met, it should, in principle, refund the full tour fee it has collected. It cannot simply apply the deductions for a traveler-initiated cancellation. Whether you can also claim compensation depends on when you were notified, the contract terms, and your actual losses.

Before doing anything, do not click “Cancel for personal reasons” in the order. Ask the agency to confirm in writing why the tour will not go ahead, then check the refund amount, processing time, and payment method. If the actual reason is a road closure, disaster, or similar event, it should not be treated the same as a tour being canceled solely because the group is too small.

First, establish whether the tour did not reach the minimum group size or you chose to withdraw

“Itinerary canceled” describes the outcome; responsibility depends on the reason. Check the travel contract, booking page, and chat records, paying particular attention to the minimum group size, the deadline for confirming the tour, what happens if the group does not reach the minimum size, and the contracting party. Different situations call for different approaches:

  • The travel agency clearly says there are not enough people and it will not run the tour: This is a cancellation because the minimum group size was not met. The refund should be handled under the applicable rules, not by charging the traveler a cancellation fee for withdrawing from the tour.
  • The agreed waiting period for confirming the group is still ongoing, but you do not want to wait: This is not necessarily the same as a cancellation by the travel agency. First check whether you can cancel without a fee and what the contract says about charges if the traveler terminates the contract.
  • The group has been confirmed, but the agency later cancels for business reasons: The agency cannot explain this simply as “the group did not form.” You should further check whether this constitutes a breach of contract.
  • Travel is impossible due to force majeure or similar circumstances: This may involve deducting costs already paid to suppliers that are non-refundable, but there must be a proper basis for the deduction. A vague “handling fee” cannot be charged across the board.

The payment page may describe the payment as an “advance payment,” “booking deposit,” or “deposit,” but the label alone does not determine whether it is refundable. In particular, if the travel agency cancels because the group is too small, its refusal to refund on the sole ground that “the deposit is non-refundable” is not automatically justified.

What should be refunded, and what losses must be claimed separately?

Under the Tourism Law of the People’s Republic of China, if a tour cannot go ahead because the agreed group size has not been met, notice must be given at least seven days in advance for domestic travel. If the contract is terminated because the group is too small, all amounts collected from the traveler must be refunded. Western Sichuan is a domestic destination; if notice is given less than seven days in advance, liability for breach of contract should also be assessed in light of the contract and relevant rules.A “tour fee refund” and “compensation for losses” are two separate matters. Refunding the principal does not necessarily settle all liability.

If the agency says, “We booked the vehicle and held the hotel rooms, so we can only refund part of the fee,” first ask it to explain the basis for the deduction. If the tour is canceled solely because the agreed minimum group size was not met, the agency cannot automatically pass on to travelers the costs of resources it booked in the course of its business. If the cancellation is genuinely due to force majeure or another reason, check the itemized costs, proof of payment, suppliers’ cancellation and refund rules, and whether the agency has taken steps to mitigate its losses.

Round-trip flights, train tickets, or accommodation near the meeting point that you booked separately may not be included in the tour fee refund. To claim these losses, keep evidence of cancellation or change fees, explain how they relate to this cancellation, and take reasonable steps to cancel or change the bookings in a timely manner. Whether you can be compensated, and how much, depends on factors such as liability, foreseeability, and evidence of the losses. Do not assume that all expenses will be compensated.

A clear refund request is more effective than repeatedly asking for updates

  1. Document the cancellation. Keep the order, contract, proof of payment, and any record showing that the agency said there were “not enough people” or that it “could not run the tour.” After a phone conversation, send a written message confirming what was discussed to avoid the cancellation later being recorded as traveler-initiated.
  2. Identify the responsible party. Check the travel agency named in the contract, the payment recipient, and the seller shown on the order. If you booked through a reseller, submit your request to both the sales channel and the travel agency named in the contract. Do not rely only on reminders to the tour leader in a temporary group chat.
  3. Set out your requests in one message. State the order details, departure date, and amounts paid, and ask the agency to confirm the total refund, whether any deductions will be made and on what basis, when the refund will be initiated, and when it is expected to reach your account. List any additional losses separately rather than combining them with the tour fee refund.
  4. Verify the refund progress. “Request recorded” or “being processed by finance” does not mean that the refund has actually been initiated. Ask for verifiable refund status or proof, and check the original payment account. You should not have to pay a security deposit or provide your payment password to receive a refund.

You can send the following message: “As you have informed us that this booking has not reached the agreed minimum group size and cannot depart as scheduled, I am requesting a refund of the tour fee paid. Please confirm in writing the reason for the cancellation, the refund amount, the processing date, and the expected date the refund will reach my account. If you intend to make any deductions, please provide the specific basis and an itemized breakdown. This request is not a traveler-initiated cancellation for personal reasons.”

There is no universal answer to how long a refund takes based on what is “usual.” Distinguish between the processing period promised by the travel agency, the date the refund is actually initiated, and the processing time of the payment channel. If the date promised by the agency has passed, follow up using the original written records and do not accept an open-ended “please wait a little longer.”

You do not have to agree on the spot to a transfer, postponement, or change of itinerary

After a tour fails to reach the minimum group size, the agency may suggest transferring you to another travel agency, changing the date, or paying a price difference to switch to a private small-group tour. You can consider these options, but they are not mandatory conditions for a refund. A transfer requires your consent. Verify the receiving travel agency, itinerary, accommodation, transportation, fees, and arrangements for responsibility. If you postpone, reconfirm the group-size conditions so the original booking is not left unresolved indefinitely.

If you do want to change destinations, first put in writing how the original booking will be refunded or credited, then compare the new itinerary. For example, if you prefer landscape photography and historic water towns, you can look into the Li River, West Lake, Suzhou gardens, and ancient towns included in Guilin → Hangzhou → Suzhou. Whether to book a different itinerary still depends on your vacation dates and interests; a new itinerary cannot replace a refund process to which you have not agreed.

If negotiations do not resolve the matter, you can contact the relevant tourism complaint-handling body or the competent culture and tourism authority, or submit the matter through 12345, providing the contract, proof of payment, cancellation notice, and a clear statement of your request. If there is a dispute over compensation, you may choose arbitration or litigation in accordance with the contract and applicable law. If the agreement states that “neither party will have any further claims once the funds have been received,” first confirm whether this also covers additional losses before deciding whether to sign.
